Wise Dumpsters Inc. (“WD”, “we”, “us”), with its principal place of business at 1702 N Parkside Drive, Pittsburg, CA 94565, agrees to rent roll-off dumpster equipment (the “Equipment”) to the customer named on the order (“Customer”, “you”) under the following terms and conditions. These terms apply to both residential and commercial rentals and, together with your order confirmation and receipt (the “Rental Documents”), form the entire agreement between you and WD.
1. Ordering and acceptance
WD accepts orders by telephone, by email and through this website. When you place an order and WD accepts it, a binding rental agreement exists between you and WD under these terms. All orders are subject to Equipment availability. Online orders are paid in full at the time of booking; the online price shown before payment is the price charged.
By checking the acceptance box in the online booking, or by replying to a quote by email, you confirm that you have read and agree to these terms and you authorize WD to charge the card on file for the rental and for any fees described below.
2. Rental period and extra days
- General debris containers (10, 20, 30 and 40 cubic yard): 7 days included.
- Heavy material containers (clean soil, clean concrete, mixed soil & concrete, asphalt, bricks): 3 days included.
- After the included period, each additional calendar day is billed at $40 per day per container on site.
- Equipment may not remain on site for more than 15 days without activity. If a container has not been swapped or removed within 15 days, WD may remove it, swap it or charge a new full rental.
- A swap (also called dump-and-return or swap-out) is treated as a new rental: the same rates apply and the rental period restarts.
3. Weight limits and overweight
Each general debris container includes a weight allowance: 10 yd — 1 ton, 20 yd — 2 tons, 30 yd — 3 tons, 40 yd — 4 tons. Loads over the allowance are billed at $145 per ton, prorated from the landfill weight ticket, which we send you with the final invoice. Heavy material containers have no weight limit but must contain one clean material only (see section 4).
You are solely responsible for complying with the weight limits of the Equipment and with any local, county or state rules on the weight that may be stored in or transported with it. Rain and water that accumulate in an open container add weight; please cover or tarp the load in wet weather. If WD incurs landfill charges, fines or penalties because a load exceeds the applicable limits (“Overload Expenses”), you agree to reimburse them. Containers filled above the rim cannot be transported; WD may charge up to $80 per cubic yard over the volume limit (“Overload Fee”) in addition to any Overload Expenses.
4. Heavy material containers
- Flat rates for heavy boxes are for one material only: clean soil, clean concrete, asphalt or bricks. Do not mix. Less than 5% contamination is tolerated.
- Mixed soil & concrete boxes accept dirt, rocks, concrete, asphalt, sand, brick and tar gravel, but not mud or wet concrete. Improperly placed material is removed at a minimum charge of $150.
- Gravel, stucco and sand are not flat rate and are dumped by weight at $150 per ton.
- Wet dirt is not allowed. A $300 handling fee applies to unload a wet dirt load. If any other material is found mixed in after dumping, a minimum $300 cleanup fee applies.
- If a heavy material container contains general debris (household waste, wood, drywall, stucco, roofing, green waste or garbage), the order is treated as a general debris rental and overweight charges apply.
5. Prohibited items and items with an extra charge
Never place in the container: propane tanks, light bulbs, automotive batteries, wet paint, oil, medical waste, liquids, flammables, or any other item defined as hazardous by federal, state or local law. A minimum fee of $150 applies to return hazardous material found in a load. Appliances that contain Freon (refrigerators, freezers, A/C units) are accepted only if you tell us before loading and pay the surcharge below; an undeclared Freon item is treated as hazardous material.
The following items may be placed in the container and carry an additional fee:
- Electrical and electronic devices (fans, toasters, mixers, televisions, tablets, computers and similar): $35 each.
- Tires: $30, $50 or $80 depending on size.
- Mattresses, box springs, sofas, couches and other large or bulky items: $35 each.
- Refrigerators, freezers, A/C units or any item containing Freon (declared in advance): $80 depending on size.
- Treated wood and other special-handling materials are priced on request; please ask before loading.
6. Delivery, pickup and site access
WD will use commercially reasonable efforts to deliver and pick up on time. Weather, road and traffic conditions, accidents, landfill delays and equipment failure are outside our control, so WD cannot guarantee delivery or pickup times and is not liable for costs or losses caused by such delays. Once the container is placed, do not move it or have it moved without WD’s prior consent.
Delivery and pickup require roughly 50 feet of straight-line access, 15 feet of width and 21 feet of overhead clearance. WD is not responsible for property damage caused by insufficient space. If WD arrives and cannot deliver or pick up for a reason beyond its control (overloaded container, low power lines or branches, blocked access, locked gates, inaccessible driveway, prohibited items in the load), a dry run fee of $150 applies; if WD incurs additional costs because of the failed trip, the fee may be increased to recover them.
7. Permits
A container placed on your own property (driveway, yard) normally needs no permit. Placing it on a public street may require a permit from your city. Obtaining and maintaining any required permit, license or approval is your sole responsibility; WD can point you to the right office but does not apply on your behalf.
8. Equipment substitution
If the size you ordered is not available on the delivery date, WD may deliver a larger container instead and will let you know the same day. The volume and weight allowance of your original order still apply.
9. Payment, saved card and later charges
Online rentals are paid in full at booking through Stripe; WD never sees or stores your card number. Your card is kept on file with Stripe for the charges described in these terms: overweight, extra days, dry run, prohibited or extra-charge items, cleanup and cancellation fees. Final invoices for such charges may take up to 30 days after pickup, because landfill tickets arrive later, and the card on file is charged at that time without further notice. You receive a receipt by email for every charge. Material purchases are non-refundable once charged.
10. Cancellations
Once an order is placed and accepted, it may be cancelled only with WD’s consent. If WD accepts a cancellation, a fee of $25 applies when you cancel before the scheduled delivery day, and $150 when you cancel on the delivery day or after the truck has been dispatched. To cancel or reschedule, call (510) 992-2652 as early as possible.
11. Recycling receipts
If you need a recycling or disposal receipt (for example for a city or LEED requirement), tell us before placing the order. Requirements, disposal fees and distances vary by city and may change the final price.
12. Responsibility and indemnity
You are financially responsible for all charges related to the container, including overweight, daily rental and trip fees described here. You agree to indemnify, defend and hold harmless WD and its officers, employees, agents and affiliates from any third-party claim, loss, fine or expense arising from: Overload Expenses; your failure to obtain a required permit; prohibited substances placed in the Equipment; loss, theft, damage or destruction of the Equipment during the rental; personal injury or property damage related to your use or possession of the Equipment; damage to streets, roadways or driveways caused by the Equipment; or your breach of these terms.
13. Failure to pay
If any amount owed under this agreement is not paid, WD may, at its option, exercise its rights under California mechanic’s lien law against the improved property, as a contractor or supplier that improved the property may do. A lien must be recorded with the county recorder, generally within 90 days of substantial completion, and can be released only by a recorded release signed by WD. WD does not waive its lien rights. If a lien is recorded against your property, you are advised to consult an attorney.
14. Entire agreement; changes
Upon WD’s acceptance of your order, these terms and the Rental Documents (including the requirements published on this website) are the entire agreement between you and WD. No other statement or correspondence modifies them, and no change is valid unless approved by WD in writing. Quoted prices are valid for 30 days. WD may update these terms for future rentals by publishing a new version on this page; the version you accepted at booking is the one that applies to your order.
